1. Acceptance of Terms

By accessing and using the Festival Registration Platform ("Platform", "Service", "we", "our", or "us"), you accept and agree to be bound by these Terms of Service ("Terms"). The Festival Registration Platform is a service provided by Incrementic, a design and innovation studio. If you do not agree to these Terms, you must not use the Platform.

2. Description of Service

The Platform provides a web-based service for festival registration and management, allowing:

• Artists to register for festivals and submit their work
• Festival organizers to manage registrations and submissions
• Integration with Google Sheets for data export and management
• Payment processing for festival registration fees
• Communication and portal features for artists and organizers

3. User Accounts

3.1 Account Creation

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this age requirement.

4. User Conduct

You agree not to:

• Use the Platform for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Platform or other accounts
• Interfere with or disrupt the Platform's operation
• Use automated systems to access the Platform without permission
• Impersonate any person or entity
• Submit false, misleading, or fraudulent information
• Harass, abuse, or harm other users
• Violate intellectual property rights

5. Submissions and Content

5.1 Your Content

You retain ownership of all content you submit to the Platform, including artwork, images, descriptions, and other materials ("Your Content"). By submitting Your Content, you grant us and festival organizers a license to:

• Display, store, and process Your Content on the Platform
• Use Your Content for festival management and administration
• Share Your Content with festival organizers and judges as necessary
• Use Your Content for promotional purposes related to the festival (with your consent)

5.2 Content Standards

Your Content must:

• Be original or you must have the right to use and submit it
• Not infringe on any third-party rights (copyright, trademark, privacy, etc.)
• Not contain illegal, harmful, or offensive material
• Comply with all applicable laws and regulations

6. Payments and Fees

6.1 Registration Fees

Festival registration fees are set by individual festival organizers. All fees are displayed before you complete registration. By submitting payment, you agree to pay the specified amount.

6.2 Payment Processing

Payments are processed through third-party payment processors. We do not store your full payment card information. You agree to provide accurate payment information and authorize us to charge your payment method for the agreed-upon fees.

6.3 Refunds

Refund policies are determined by individual festival organizers. We are not responsible for refund decisions made by festival organizers. Contact the festival organizer directly regarding refund requests.

7. Google Sheets Integration

The Platform offers integration with Google Sheets for festival organizers. By connecting your Google account:

• You grant us permission to access your Google Sheets and Google Drive (read-only) as necessary for the integration
• You understand that we will export submission data to your selected Google Sheet
• You are responsible for maintaining the security of your Google account
• You can revoke access at any time through your Google account settings or Platform settings
• We encrypt and securely store your OAuth tokens

We are not responsible for any issues arising from your use of Google Sheets or any actions taken within your Google account.

8. Intellectual Property

The Platform, including its design, features, functionality, and content (excluding Your Content), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Platform without our express written permission.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

The Platform is provided "as is" and "as available." We do not guarantee that the Platform will be uninterrupted, error-free, or secure. We reserve the right to modify, suspend, or discontinue the Platform at any time.

9.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

9.3 Festival Organizer Responsibility

We are not responsible for the actions, decisions, or policies of festival organizers. Festival organizers are independent entities, and any disputes regarding festivals should be directed to the respective festival organizers.

10. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the Platform
• Your Content
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

We may terminate or suspend your account and access to the Platform at any time, with or without cause or notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. We may also delete your account and data, subject to our Privacy Policy and applicable law.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
